Terms of Service - KoBot Discord Bot

1. Acceptance of Terms

By inviting, adding, or using KoBot ("the Bot") in your Discord server, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Bot.

2. Description of Service

KoBot is a Discord bot developed by Kopo® (kopo.systems) that provides various features including:

• AI-powered commands using OpenAI's ChatGPT
• Server management tools (Minecraft, VPN)
• Entertainment and interactive features
• Automatic user profile generation based on messages

3. Age Requirements

You must be at least 13 years old (or the minimum age required in your country) to use Discord and this Bot. By using the Bot, you confirm that you meet these age requirements.

4. User Conduct

When using the Bot, you agree to:

• NOT use the Bot for illegal activities
• NOT attempt to exploit, hack, or damage the Bot
• NOT use the Bot to harass, abuse, or harm others
• NOT bypass or attempt to bypass any Bot restrictions or rate limits
• Respect Discord's Terms of Service and Community Guidelines

5. AI-Generated Content

The Bot uses OpenAI's ChatGPT to generate responses and descriptions. You acknowledge that:

• AI-generated content may be inaccurate, inappropriate, or offensive
• The Bot's responses do not represent the views of Kopo® or the Bot developers
• You use AI-generated content at your own risk
• The Bot is designed for entertainment purposes and humor

6. Auto-Description Feature

The Bot may collect and analyze public messages to generate user descriptions:

• This feature can be disabled per server using /config
• Collected messages are used solely for generating descriptions
• Server administrators can control this feature
• Users consent to message analysis by using servers where this feature is enabled

7. Data Collection and Usage

The Bot collects and stores:

• User IDs, usernames, and nicknames
• Server IDs and server names
• Message content (when auto-description is enabled)
• Command usage statistics
• Game scores and competition data

8. Server Management Features

For features involving server management (Minecraft, VPN):

• Server administrators are responsible for their own infrastructure
• Kopo® is not liable for data loss, downtime, or security breaches
• You must have proper authorization to manage servers through the Bot
• SSH keys and credentials are stored at your own risk

9. API Costs and Rate Limiting

• The Bot uses OpenAI's API, which incurs costs
• We reserve the right to implement rate limiting or usage caps
• Excessive usage may result in temporary or permanent restrictions
• We are not responsible for API outages or service interruptions

10. Availability and Support

• The Bot is provided "as is" without guarantees of uptime
• We do not guarantee continuous, uninterrupted access to the Bot
• Support is provided on a best-effort basis
• We reserve the right to modify, suspend, or discontinue the Bot at any time

11. Prohibited Uses

You may NOT use the Bot to:

• Generate, store, or distribute illegal content
• Spam users or servers
• Collect personal information without consent (beyond normal Bot functionality)
• Impersonate others or misrepresent your identity
• Violate any applicable laws or regulations

12. Intellectual Property

• The Bot and its code are property of Kopo®
• You may not copy, modify, or redistribute the Bot without permission
• User-generated content (profiles, scores) remains the property of users
• AI-generated content is subject to OpenAI's usage policies

13. Termination

We reserve the right to:

• Remove the Bot from any server at our discretion
• Ban users or servers from using the Bot
• Terminate service without notice for violations of these Terms
• Delete stored data upon termination

14. Disclaimer of Warranties

THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOPO® AND THE BOT DEVELOPERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from use or inability to use the Bot
• Damages caused by AI-generated content
• Security breaches or unauthorized access

16. Indemnification

You agree to indemnify and hold harmless Kopo®, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Bot
• Your violation of these Terms
• Your violation of any third-party rights

17. Third-Party Services

The Bot integrates with third-party services:

• Discord: Subject to Discord's Terms of Service
• OpenAI: Subject to OpenAI's Terms of Use and Usage Policies
• SSH/Server Management Kopo: Subject to your server provider's terms

We are not responsible for third-party service outages or policy changes.

18. Privacy and GDPR Compliance

• We comply with applicable data protection laws
• EU users have rights under GDPR (see Privacy Policy)
• You can request data deletion by contacting us
• Server administrators can delete server data using /config

19. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting for material changes
• After 30 days for non-material changes

Continued use of the Bot after changes constitutes acceptance of new Terms.

20. Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles. Any disputes shall be resolved in the courts of France.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kopo® regarding the Bot.
